Terms & Conditions

1.1 These User Terms & Conditions ("Terms") govern access to and use of the ZeroPark mobile application, website, and related services (collectively, the "Platform") operated by ZeroPark Smart Parking, a company incorporated under the laws of India, having its registered office at ZeroPark Smart Parking, Chennai - 600 032 ("ZeroPark," "we," "us," or "our").

1.2 By creating an account, browsing spot listings, or booking a parking reservation through the Platform, you ("User," "you") agree to be bound by these Terms, our Privacy Policy, our Refund & Cancellation Policy, and our Community Guidelines. If you do not agree, do not use the Platform.

1.3 These Terms apply to Users seeking to discover and book parking spots. A separate agreement — the Parking Provider Terms & Conditions — governs individuals or entities who list parking spots ("Providers") on the Platform.

1.4 ZeroPark is a technology marketplace that connects Users with independent Providers of parking spaces. ZeroPark does not own, operate, or manage any physical parking spot listed on the Platform unless expressly stated.

2.1 You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872, to create an account.

2.2 You must provide accurate, current, and complete information during registration, including a valid email address and mobile number, and keep this information updated.

2.3 ZeroPark reserves the right to refuse service, suspend, or terminate accounts at its discretion, including for suspected fraud, misuse, or violation of these Terms.

3.1 You may register using email/password, mobile OTP, or supported OAuth providers (Google/Apple).

3.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@zeropark.in of any unauthorized use.

3.3 One individual may not maintain more than one active User account except as permitted by ZeroPark in writing.

3.4 ZeroPark uses your registered mobile number and email to send transactional communications (OTPs, booking confirmations, receipts) and, where you have consented, promotional communications.

4.1 The Platform allows Users to:

• Search for parking spots by location, radius, price, and amenities/features;
• View real-time slot availability, resolved pricing, and provider-listed amenities;
• Reserve a specific parking slot or allow auto-assignment;
• Make payment for reservations via the integrated payment gateway;
• Check in/out via QR code or plate scan where supported;
• Save vehicles, view booking history, and submit reviews for completed reservations;
• Optionally subscribe to a paid plan to unlock direct Provider contact details beyond a free quota.

4.2 Slot availability, pricing, and amenities are set by Providers and may change without notice. ZeroPark displays the resolved price at the time of your search or booking; this price is locked to your reservation upon confirmation and will not change retroactively.

4.3 ZeroPark does not guarantee the physical condition, safety, security, or legal compliance of any parking spot listed by a Provider. Users book and use listed spots at their own risk, subject to Section 9 (Liability).

5.1 Payment Gateway. All payments on the Platform are processed in Indian Rupees (INR) through Razorpay, a licensed payment aggregator. ZeroPark does not store your card, UPI, or net-banking credentials; these are handled directly by Razorpay in accordance with RBI tokenisation and data-storage norms.

5.2 Reservation Charges. The total amount charged includes the resolved slot rate (hourly/daily/monthly, as applicable), any applicable convenience or service fee disclosed at checkout, and applicable taxes.

5.3 No Auto-Renewal (Reservations). Parking reservations are one-time bookings and do not auto-renew. Extensions must be actively requested by the User through the Platform.

5.4 Provider Contact Unlock Subscriptions. ZeroPark may offer optional paid subscription tiers (billed in INR) that increase the number of Provider contact details you may unlock beyond the free monthly quota. Subscriptions are billed as a one-time, non-auto-renewing charge for the applicable period unless otherwise clearly disclosed at the time of purchase. Subscription terms, tiers, and renewal mechanics are detailed on the in-app subscription/account page at the time of purchase.

5.5 Failed/Disputed Payments. If a payment fails after a reservation is created, the reservation may be automatically cancelled or held pending payment confirmation, per the flow shown in the app.

5.6 Refunds & Cancellations. Cancellation windows, no-show policies, and refund timelines are governed by the separate Refund & Cancellation Policy, which is incorporated into these Terms by reference.

6.1 You agree to:

• Provide accurate vehicle and reservation details;
• Arrive and depart within your booked reservation window, or extend via the Platform;
• Use only the slot assigned to your reservation unless the Provider or Platform permits otherwise;
• Treat parking premises, Providers, and other Users respectfully;
• Comply with all applicable traffic, parking, and local municipal laws at the spot location.

6.2 You agree not to engage in conduct prohibited under our Acceptable Use Policy, including but not limited to fraudulent bookings, circumventing the Platform to transact directly with a Provider to avoid fees after being introduced through ZeroPark, scraping the Platform, or submitting false reviews.

6.3 Repeated no-shows, late check-outs, or policy violations may result in reservation restrictions, account suspension, or termination.

7.1 You may submit a review only for a spot associated with a completed reservation on your account.

7.2 Reviews must be honest, relevant, and free of hate speech, harassment, personal data of third parties, or unlawful content. ZeroPark may remove reviews that violate these Terms or the Community Guidelines.

8.1 The Platform, including its software, design, trademarks, and content (excluding Provider-submitted listing content and User-submitted reviews), is owned by ZeroPark or its licensors and protected under Indian copyright and trademark law.

8.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial parking discovery and booking purposes.

9.1 The Platform is provided on an "as is" and "as available" basis. ZeroPark does not warrant uninterrupted or error-free operation, or the accuracy of Provider-supplied listing information.

9.2 ZeroPark is a marketplace facilitator, not a party to the parking arrangement between User and Provider. ZeroPark is not liable for any loss, theft, or damage to vehicles or property at a parking spot, acts or omissions of Providers, or disputes between Users and Providers, except to the extent required by applicable Indian law.

9.3 To the maximum extent permitted by law, ZeroPark's aggregate liability arising from or relating to your use of the Platform shall not exceed the total amount of fees paid by you to ZeroPark (excluding amounts passed through to Providers) in the three (3) months preceding the claim.

9.4 Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Indian law.

11.1 ZeroPark may suspend or terminate your account, with or without notice, for violation of these Terms, suspected fraud, non-payment, or misuse of the Platform.

11.2 You may delete your account at any time via account settings or by contacting support@zeropark.in. Certain records may be retained post-deletion as described in the Data Retention Policy and Privacy Policy for legal, tax, and dispute-resolution purposes.

13.1 These Terms are governed by the laws of India.

13.2 Any dispute shall first be attempted to be resolved through good-faith negotiation, failing which it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Chennai, with proceedings conducted in English. Subject to the foregoing, the courts at Chennai shall have exclusive jurisdiction.

15.1 Entire Agreement. These Terms, together with the Privacy Policy, Refund & Cancellation Policy, Community Guidelines, and Acceptable Use Policy, constitute the entire agreement between you and ZeroPark regarding Platform use.

15.2 Severability. If any provision is held invalid, the remaining provisions continue in full force.

15.3 No Waiver. Failure to enforce any right under these Terms does not constitute a waiver of that right.
